If this is your second DUI offense within a 5 year period, you may be sentenced to up to one year in jail, 5 days of which are mandatory. You must also pay fines ranging from $1,100 to $5,100 and you face a one-year driver’s license suspension, and you must attend DUI School.

For your third offense, you face up to 1 year in jail, of which 60 days are mandatory. The fines range from $2,100 to $10,100 and your driver’s license will be suspended for 3 years. Again, you must attend DUI School

The above offenses are misdemeanors, but a fourth offense is considered a felony. For a fourth offense, you will spend at least 1 year in state prison, with up to a possible 10-year sentence. The fines jump up to between $4,100 and $10,100, and your driver’s license will be suspended for 5 years.

In addition to different penalty, you will be required to get SR-22 insurance for your vehicle. This insurance is more expensive than normal auto insurance policies. You will also be required to attend and complete a DUI or other substance abuse program.
